Park County deputies involved in a deadly February shootout will not face charges

PARK COUNTY, Colo. – The Park County sheriff’s deputies involved in a fatal shootout in Bailey in February will not be charged for the incident.

Undersheriff Dave Wohlers confirmed the 11th Judicial District Attorney’s Office decision on Tuesday.

Deputies shot and killed Martin Wirth at his home. Investigators say Wirth opened fire on the deputies while they were trying to serve him an eviction notice. 

Wirth had been fighting eviction for years, according to Colorado Foreclosure Resistance Coalition website.

Three deputies were hit in the shootout, one of them died from his wounds.

The family of Corporal Nate Carrigan, filed a notice of claim Monday, putting the sheriff’s office on notice that they plan to sue the sheriff’s office over how the eviction was carried out.
