Littleton man faces lawsuit from HOA over garden mulch

LITTLETON, Colo. -- A Littleton man's battle over mulch in his yard is headed to court.

Isaac Puckett wanted to take a patch in front of his townhome and improve it. So, he said he put in an application to his homeowners’ association to do the work. But when he didn't hear back, he started the work.

Puckett said after completing the project, the HOA came back rejecting his request. The HOA said black mulch wasn't the recommended red cedar gorilla hair. The two sides battled through the summer, and a few weeks ago, the HOA filed a lawsuit against him.

“They are asking for damages for the community," Puckett said. "They’re asking the courts to provide an injunction to force me to put the garden back to the original gorilla hair mulch state.”

He filed a counterclaim Monday.

Denver7 reached out to the HOA. They tell us they have a legal obligation to review and enforce standards and will not comment on pending litigation.
