A 39-year-old woman has been sentenced to six years for running over her husband and killing him during a fight.
Nancy Jo Arias was convicted in June of manslaughter, vehicular homicide and DUI in the death of her husband Phillip Anthony Lobato last summer.
She was sentenced to six years for vehicular homicide and six years for reckless manslaughter. The judge made the sentences concurrent and gave her credit for 325 days already served. The judge sentenced Arias for time served on the DUI.
Arias said she and her husband were having a heated argument in the car and he hit her with his hand. She says she told him to get out of the vehicle but says he continued to hit her through the open window.
The incident took place in August 2014 at Hill Top Liquor, 2735 W. 72nd Avenue in Westminster.
According to an arrest affidavit, Arias told police, "You might as well take me now. I ran over him," shortly after they arrived at the location. She told police she and her husband were arguing about infidelity.
Arias told police she threatened to hit Lobato with the car and he taunted her, saying that she wouldn't do it, according to the affidavit.
"I contemplated and then I hit him," she is quoted as saying in the affidavit. "I'm one of those persons who get the last word."
Lobato was pronounced dead at the hospital. Arias was arrested by Westminster police at the scene.
During her trial, prosecutors argued her husband was no longer a threat at that point and Arias had many other choices she could have made.
Court records showed Lobato and Arias had been together since they were 14 years old.
