DENVER (AP) — Prosecutors say a police officer was justified when he shot a man who brandished a pellet gun during a confrontation in Castle Rock south of Denver.

The Denver Post reports 67-year-old Charles Rees called 911 on Christmas Eve saying he needed help, but that he would shoot any police or medical personnel who showed up. A second 911 call came from Rees’ wife, who told dispatchers that her husband was drunk and that he wanted police to shoot him.

When officers went inside his home, Rees met them in a hallway and brandished a pellet gun that resembled a .45-caliber handgun.

One of the officers fired four rounds from a rifle, striking Rees once in the right arm. Rees survived and is facing four counts of felony menacing.
