Man shot by Frisco police in Whole Foods parking lot pleads guilty to assault charges

FRISCO, Colo. — A man shot by Frisco police in a Whole Foods parking lot in January pleaded guilty to the charge of second degree felony assault on a peace officer, Fifth Judicial District Attorney Bruce Brown announced.

Derek Baker, 34, of Loveland, entered his plea before a Summit County District Court judge on Monday. The charges stem from a January 14 incident outside the Frisco market.

Police were called to the Whole Foods store around 7:30 p.m. after Baker assaulted another shopper. But as they approached the store, Baker was in his car trying to take off.

Officers fired two shots into Baker’s windshield after police say he struck a State Patrol car and then accelerated toward a Frisco police officer as he attempted to flee.

Baker was wounded in the arm and treated and released from the hospital the same day. No officers were injured.

Prosecutors said Baker has a history of mental instability. The court will determine if he is eligible for mental health treatment.

Baker is facing up to 12 years in prison. His sentencing is scheduled for August 26.
