DA files motion to dismiss sex assault case against son of former Denver Mayor Wellington Webb

DENVER — Citing a lack of evidence and a reluctant victim, the Denver District Attorney’s Office filed a motion Friday to dismiss an alleged sexual assault case against the son of former Denver Mayor Wellington Webb.

Allen Wayne Webb, 55, was arrested in April and charged with seven felony counts of sex assault on a child, including several counts of child sexual assault by a person in a position of trust and against a child under the age of 15.

According to a release from the DA’s office, the named victim in this case, who is now an adult, does not wish to proceed with prosecuting the case and therefore the charges in this case could no longer be proven beyond a reasonable doubt.  

Prosecutors say they have an ethical duty to dismiss charges if they determine there is no longer sufficient evidence to prove a case beyond a reasonable doubt.

Webb has a long history of arrests going back decades, on charges including sexual assault, driving under the influence, harassment and robbery.
